03/10/2004Order/ProceduralFiled Order. Granting Motions and Consolidating Appeals. In No. 42432, appellants have moved for leave to amend the district court judgment on grounds of clerical mistake. Respondents oppose the motion, but still request that the judgment be amended. Appellants have also moved for leave to file a reply to respondents' opposition. Cause appearing, we grant appellants leave to file a reply to respondents' opposition. The clerk shall detach and file the reply appended to appellants' motion as Exhibit A. Cause appearing, we grant the parties leave to pursue, in the district court, correction of any clerical mistakes that may exist in the district court's judgment. Because it is the within the district court's discretion as to whether to correct its judgment, we deny the parties' request for this court to make such decisions. No leave of this court is necessary for the district court to consider the merits of a proper NRCP 60(b) motion. In the event the district court is inclined to grant relief under NRCP 60(b), the parties must comply with the procedures for remand set forth in Huneycutt. The parties must provide this court with an order of the district certifying its inclination to grant the parties' requested relief.
