This denial is without prejudice to respondent's right to renew the motion, if necessary, upon completion of settlement proceedings. We note that while counsel for appellant, attorney Timothy A. Hill, is a licensed Nevada attorney, it does not appear that he maintains a Nevada office. Accordingly, Mr. Hill shall have 20 days from the date of this order to comply with SCR 42.1 by filing a notice of association or designation of a Nevada attorney maintaining a Nevada office upon whom all papers, process or pleadings shall be served. 04-07927

Accordingly, settlement proceedings are concluded and this appeal may proceed. Briefing and the requesting of transcripts shall remain suspended, however, pending further order of this court. In his report, the settlement judge also indicated that the appeal might be jurisdictionally deficient and frivolous. Accordingly, the settlement judge recommends that sanctions should be imposed against appellant. Our review of the docketing statement and the documents submitted to this court pursuant to NRAP 3(e) reveals a potential jurisdictional defect. Appellant shall have 30 days from the date of this order to show cause why this appeal should not be dismissed for lack of jurisdiction. Additionally, we note that on April 30, 2004, and June 29, 2004, this court entered orders directing counsel for appellant, attorney Timothy A. Hill, to comply with the provisions of SCR 42.1. As of the date of this order, Mr. Hill has not responded to those orders in any manner. Mr. Hill shall have 15 days from the date of this order to comply with SCR 42.1. Also, within 30 days from the date of this order, Mr. Hill shall show cause why sanctions should not be imposed pursuant to the settlement judge's report. Failure to comply with this order in any respect may result in the imposition of sanctions, including referral to the State Bar of Nevada. 04-20171
