Matamoros has moved to dismiss this appeal, arguing that Langon's October 3, 2003 notice of appeal is ineffective because he filed it before the formal resolution of his motion for judgment notwithstanding the verdict or a new trial. However, Langon filed an amended notice of appeal to correct the jurisdictional defect. We construe Langon's January 12, 2004 notice of appeal as intending to appeal the underlying judgment as well as the district court's denial of his motion for a new trial. Langon's opposition incorrectly asserts that an order denying summary judgment is independently appealable under NRAP 3A(b). An order denying summary judgment is not independently appealable, although it may be reviewed on direct appeal from any adverse final judgment. Accordingly, we deny Matamoros' motion to dismiss this appeal. 04-09566
