Accordingly, we deny the motion to dismiss. Further, cause having been shown, we grant appellants' request to file an untimely motion for an extension to file the opening brief. Appellants shall have 30 days from the date of this order to file and serve the opening brief and appendix. Thereafter, briefing shall proceed in accordance with NRAP 31(a)(1). No further extensions of time shall be permitted absent demonstration of extreme and unforeseeable circumstances. Counsel's caseload will not be deemed such a circumstance. 03-17083

04/14/2004Order/ProceduralFiled Order. Regarding Transcripts, Directing the Filing of Answering Brief and Denying Motion. We are unable to determine whether all transcripts necessary for the review of this appeal have been filed with this court or included in appellants' appendix. Accordingly, appellants shall, within 10 days from the date of this order, file and serve an amended transcript request form setting forth, among other things, the specific trial or hearing dates to be transcribed. NRAP 9(a). Further, appellants shall, within the same time period, file a supplemental appendix containing certified copies of all transcripts that were cited to in the briefs but have not been filed with this court. We vacate that portion of our October 15, 2003, order directing Ms. Sichak, Ms. Sharp, and Ms. Terhune to file requested transcripts with this court. On November 14, 2003, appellants filed the opening brief and appendix. To date, respondent Estate of Ray Hunter Nygren ('Estate') has not filed its answering brief. Estate shall have 20 days from the date of this order to file and serve its answering brief. Appellants shall have 30 days from service of Estate's answering brief to file and serve a reply brief, if deemed necessary. Respondent Nygren has moved for leave to file a 'surreply.' Appellants oppose the motion. We conclude that it is premature at this time to determine whether the reply brief contains arguments improperly raised for the first time on appeal. Accordingly, we deny respondent's motion to file a 'surreply.' The clerk of this court shall return, unfiled, the proposed document received on January 27, 2004. We remind the parties that in resolving this appeal, this court will disregard any issue that is improperly raised on appeal or any factual matters or arguments improperly included in the parties' briefs. 04-06924

09/20/2004Order/ProceduralFiled Order. Regarding Transcripts, Granting Motion to file Surreply and Striking Opening and Reply Briefs. On April 30, 2004, appellants filed an amended transcript request form and a supplemental appendix containing 2 volumes of various transcripts. The amended transcript request form requested, among other transcripts, the July 7, 1999; October 21, 1999; and December 11, 2001, transcripts. We note, however, that the aforementioned transcripts were not included in the supplemental appendix. We further note it does not appear appellants cite to those transcripts in their briefs. Accordingly, we conclude that this court has all the transcripts necessary for the resolution of this appeal. Thus, no action will be taken with respect to appellants' request for the July 7, 1999; October 21, 1999; and December 11, 2001, transcripts. Respondent has filed a renewed, more detailed motion for leave to file a surreply. Appellants do not oppose the motion. Cause appearing, we grant the motion. The clerk of this court shall file the surreply received on April 23, 2004. In resolving this appeal, this court will disregard any issue that is improperly raised on appeal or any factual matters or arguments improperly included in the parties' briefs. Appellants have filed a document entitled 'Declaration of Samuel G. Broyles, Jr., Esq. Re: Errata to Appellants' Opening Brief and Appellants' Reply Brief.' Our review of the 5-page document reveals that the opening and reply briefs contain approximately 32 errors. In light of the number of errors in the briefs, we conclude that the ends of judicial efficiency will be better served by the filing of corrected opening and reply briefs. Accordingly, this court will take no action with respect to the declaration. The clerk of this court shall strike the opening brief filed on November 14, 2003, and the reply brief filed on January 20, 2004. fn1[We note that appellants have filed 2 reply briefs. We further note that counsel for appellants did not indicate which reply brief contained the errors stated in the declaration. Our review of the declaration and the 2 reply briefs filed, however, reveals that the reply brief filed on January 20, 2004, contained the errors stated in the declaration. We admonish counsel for appellants for not indicating which reply brief contained the errors stated in the declaration.] Appellants shall have 15 days from the date of this order to file and serve a corrected opening brief and a corrected reply brief. The briefs shall not be substantially different and shall differ only in that they contain proper citations and other corrected errors as stated in the declaration. 04-17329
