01/09/2004Letter/IncomingFiled Letter. from attorney Alan Lefevre re: settlement. 04-00616
01/20/2004Order/ProceduralFiled Order. On January 9, 2004, counsel for appellant, attorney Alan J. Lefebvre, submitted a letter addressed to the clerk of this court representing that counsel for respondent is purposefully delaying the filing of 'dismissal papers.' Further, Mr. Lefebvre requests that the clerk 'note and confirm with the Settlement Judge, that [respondent] declined to participate in good faith.' We note that a request for relief from this court must be made by filing a formal motion not by a letter addressed to the clerk of this court. This court will only consider the imposition of sanctions for bad faith participation in the settlement conference program upon a formal recommendation by the settlement judge. Accordingly, no action will be taken based upon Mr. Lefebvre's letter. Appellant shall file a motion or stipulation to dismiss or otherwise inform this court of the status this appeal within 20 days from the date of this order. Failure to comply with this order may result in this appeal being dismissed as abandoned. 04-01058
