On July 8, 1999, this court dismissed the appeal from the final judgment for lack of jurisdiction because it appeared that the notice of appeal was untimely filed. This court also dismissed, on its merits, that part of the appeal from the special order after final judgment awarding fees and costs. On July 26, 1999, appellant submitted a proper person petition for rehearing in which he argued that the notice of appeal was timely filed. Having reviewed the petition, and respondents' proposed response, we conclude that rehearing is warranted and this appeal from the final judgment should be reinstated. Fn1[We grant respondents' motion for leave to file a response to the petition for rehearing]. Fn2[Respondents contend that rehearing is not warranted because appellant did not specify when he received notice of entry of the final judgment. In light of the procedural defect in respondents' service, we conclude that respondents' contention is without merit]. Service was not completed when the notice of entry of judgment was mailed, and appellant's notice of appeal was timely filed. We grant rehearing and reinstate this appeal from the final judgment. We do not disturb our previous order dismissing that part of the appeal from the post-judgment order awarding fees and costs. NNP99A-CY/MS/ML
